New iPhone 17 Pro Max issues after update — shop says no options left:(

Hi everyone, I’m from Sri Lanka where we don’t have an official Apple Store, so I bought a brand-new sealed iPhone 17 Pro Max (256GB) from a local retailer about 3 weeks ago. I personally unboxed it. It’s currently running iOS 26.3. Issues I’ve been experiencing The first few days I noticed small lags, but after updating the OS more problems appeared: Camera lag when switching lenses Stutters and random bugs in other apps Phone sometimes gets warm (not too hot to hold, but noticeable) These problems are intermittent, not constant, but I do have video proof. What the retailer has done Full factory reset * Reinstalled original software Issues still persist. Now they want to send it to an official service center overseas (likely Singapore) to reinstall the OS again. When I asked what happens if it’s still not fixed, they said there would be no other options, which worries me since the phone is basically new. Warranty Device has 1-year AppleCare warranty. My questions Does this sound more like a hardware defect than software? If official diagnostics don’t resolve it, should I push for a replacement unit? Is ~5 hours of usage normal given my charging range? Has anyone had a similar early-life issue with a Pro Max model? Any advice or similar experiences would really help before I proceed.
